Required Disclosures Under the MARS Act
The following disclosures are required by the Mortgage Assistance Relief Services Rule (MARS Act), enforced by the Federal Trade Commission (FTC), 16 CFR Part 322.
1. No Government Affiliation
MD Short Sale Agent is not associated with the government, and our service is not approved by the government or your lender. We are a private company that connects homeowners with licensed real estate professionals who specialize in short sales.
2. No Guarantee of Lender Approval
Even if you accept this offer and use our service, your lender may not agree to change your loan or approve a short sale. Every case is different, and lender approval depends on factors including your financial hardship, property value, outstanding loan balance, and the lender's internal policies.
3. Risks of Non-Payment
If you stop paying your mortgage, you could lose your home and damage your credit rating. We recommend that you continue communicating with your lender throughout the short sale process and consult with a qualified attorney or financial advisor about your specific situation.
4. Your Right to Cancel
You may stop doing business with us at any time. You are under no obligation to continue using our services. You may accept or reject the offer of mortgage assistance we obtain from your lender or servicer. There is no penalty for cancellation.
5. About Our Organization
MD Short Sale Agent is not required to be, and is not, a nonprofit organization. We are a lead generation and referral service that connects homeowners with licensed real estate agents and attorneys experienced in short sales in Maryland. There is no guarantee that all homeowners will qualify for a short sale or that any specific outcome will be achieved.
6. No Upfront Fees
MD Short Sale Agent does not charge homeowners upfront fees for its referral service. Real estate agent commissions in a short sale are typically paid by the lender from the sale proceeds at closing. You will not be asked to pay any fees before services are rendered.
7. What Is the MARS Act?
The Mortgage Assistance Relief Services Rule (MARS Act) is a federal regulation enforced by the Federal Trade Commission. It applies to companies that offer to help homeowners with mortgage modifications, short sales, or other forms of foreclosure prevention.
